The US Supreme Court has thrown out a law enacted by the Californian government a few years ago. The law forbids the sale of certain games to minor, and requires the games to have warning stickers if they are excessively naughty.
However, the Supreme Court was having none of it, and threw the whole thing out.
"The most basic principle-that government lacks the power to restrict expression because of its message, ideas, subject matter, or content, ... is subject to a few limited exceptions for historically unprotected speech, such as obscenity, incitement, and fighting words,” the court said in a lengthy statement.“But a legislature cannot create new categories of unprotected speech simply by weighing the value of a particular category against its social costs and then punishing it if it fails the test."
So, a victory for gamers…we guess. Though why we should celebrate the fact that kids can now legally be subject to violent videogames is a bit of a mystery.
